..........Although estate planning needs must always be assessed on an individualized basis, our firm generally recommends that our clients have at least three (3) basic documents in his or her estate planning portfolio:

1.) ..........WILL OR LIVING TRUST

..........A Will empowers you to distribute your assets after death to the individuals and charities of your choice. Without a Will, your assets may be distributed in accordance with state law, often resulting in undesirable distributions. A Will may be customized to meet your specific needs and desires regarding the distribution of all of your property. Your Will should be reviewed on an annual basis to insure its accuracy. A Living Trust is a document which allows an estate to be distributed without having to go through government interference or expense. A Living Trust can insure that your wishes are carried out while reducing or eliminating Federal Estate Taxes.

2.)..........LIVING WILL

..........A Living Will expresses, in writing, your desire to terminate life-sustaining medical treatment in the event that you fall into a terminal state with minimal or no chance of recovery. You may make the decision yourself or delegate the decision to another individual to terminate life-sustaining medical treatment, needs, etc.

3.)..........DURABLE POWER OF ATTORNEY

..........A Durable Power of Attorney permits you to elect an agent (perhaps a spouse or a child) who shall have the power to make financial and medical decisions on your behalf. A durable power of attorney may avoid the necessity of obtaining court guardianship and permit the holder of the power to care for your affairs should you ever become mentally or physically incapacitated.
